Come on, first we have the Internet Mana f*** John Key video and then a bunch of lefty losers burning a photo of John Key and poor old Laila Harre wants the apology. Man - youre kidding me right? Wrong, she wants the apology. Kind of sounds like one or two left wing bloggers on this site too, does it not?

Now the dirty tricks campaign is well and truly under way, I think it is high time we started a new thread, just to highlight how low the left will go. This one is a beauty, thanks Laila for pushing away more votes from you. Funny thing is, at best you will only see shuffling around of left votes with this rubbish. I don't think too many right of center voters in their right mind would ever be attracted to the lowest form of gutter politics, but you carry on Laila.

Been looking for a familiar name among the posters - on this and nearly every other thread - and I can't find it? At least not since yesterday. I wonder why. And I am almost keen to see one or two of the conglomerate that I will henceforth refer to as "The Mob" get just enough party votes to get into parliment this time. I think that their performance would be just enough to guarantee a reform of the whole electoral system - and the removal of Dot Com from these shores. Even if we had to put up with First-Past-The-Post for an election or two to let things settle down.

Nicky Hager's book is the biggest dirty trick so far, but I think it could work against Labour. Hagers contact hacks another computer and they complain about a National member or contact hacking into Labours. Own goal right of the bat. What really smells here is dot com and his conviction for hacking into computers. It smells as bad as the porno sites dot com runs. Is the left really so hypocritical? Well clearly, you could not possibly answer that any other way!!!

Just imagine that crowd running the country. It would be a nightmare and bloggers like myself would have a field day.
Don't be fooled New Zealand, but hey if you really want so see NZ knackered for generations, go right ahead.

This was started by Helen Clark and her Cancer ridden tactics are eroding the Left as we watch. Who in their right mind would ever contemplate or even dare for one second to vote for the Loonie left.

Two independent witnesses have placed Nicky Hagar at the Dotcom mansion on multiple occasions. Hagar has admitted to only one visit on radio this morning. It’s not true, but it doesn't matter. The important part is that the whole thing is falling apart withing 24 hours – a bit like Labour Party policy.

So here is what happened:

At the time Whaleoil was under the DDOS attack (it shut us down for a few days), we have a fair idea that it was Dotcom behind it. At the end of the period, I suddenly noticed something not right with my email. I changed the password and went on a mad dash to change all other passwords.

I suspect they entered GMAIL through brute force attack — Kim might like to boast how it was done. It doesn’t matter. After about 15 minutes I shut them out. Of about 80G of information, they were disconnected after getting only 8G of it.

I've been waiting for this day. As Dotcom said, he would do this 5 days before the election, but it appears he’s had advice to move it up a bit. As a result, it has caught me in the middle of a trip to report on the Fijian elections and the situation in Israel.
It shows you how confident Dotcom is; how cocky. He’s OK with breaking the law here. With all the railing he does against the GCSB, and data privacy (MEGA data is not private by the way – another story that’s been sitting here waiting for another day), he’s actually one of the biggest offenders of hacking and looking into people’s private information.

Leopard and spots, and all that. The convicted fraudster/hacker conman is still operating true to form.

More amusingly, he’s got a whole political party behind him now. All sorts of people on his payroll: Compromised people like David Fisher at the New Zealand Herald to “career politicians” like Laila Harre.

I wouldn’t do anything else. If you wrote what is going on in New Zealand politics now as a movie script, you’d be told it to tone it down it bit – it would be considered over the top and not realistic.

We have a villain with a German accent using piles of cash obtained in a questionable manner to buy people’s services and do his bidding.

And then there is me. I’ve called Dotcom on his crap from day one. When everyone was writing me off again. It took almost a year for the scales to fall from the media’s eyes. And worse, some people still can’t see anything wrong with Kim.

The true irony of this situation is that I am being accused of being bought. While it is now plain to see I’m one of the very few that isn’t.

It doesn’t matter. Welcome to Whaleoil, and the biggest show in town. Pull up a chair. You may not agree with everything you see here, but you’ll see it here before you see it anywhere else.

A Hager lie is exposed by the SIS.
Security Intelligence Service (SIS) director Rebecca Kitteridge has backed Prime Minister John Key's version of events around the release of information about former Labour leader Phil Goff's briefing from former SIS boss Warren Tucker on Israeli agents in Christchurch.

The incident is one of author Nicky Hager's key allegations in his Dirty Politics book.

In the book Hager quotes from emails exchanged between Whaleoil Blogger Cameron Slater and his friend Aaron Bhatnagar where Slater indicated he expected to receive documents contradicting Mr Goff's public statements that he did not receive a briefing from Mr Tucker soon after requesting them.

Hager and Mr Goff claim Slater received help from the Prime Minister's office to draft his request for the document and that Mr Key's office expedited its release. Media organisations also requested the same material but either received some time after Mr Slater or not at all.

Mr Key this afternoon denied that Slater, who is at the centre of Hager's claims of a National Party dirty tricks campaign, had received favourable treatment, or that his office had anything to do with the release of the document.

This evening an SIS spokesman said the director was "responsible for NZ SIS Official Information Act responses and made the decision to release and what to release in this case".

"Under the no surprises convention the director or a representative would normally inform the minister's office about what is being released under the OIA.

"That's what occurred in this case. Neither the PM or his office expressed a view as to whether the information should be released or to whom or when."

But Daphne, who said anything about 2 gigabytes of stolen emails that were hacked - it was 8 gigabytes right. Well wrong according to Daphne and she would know. Cameron Slater shut down his computer ASAP when he knew something was up and now it seems Hager and the dirty left tag team have blown the amount upwards that they stole buy 6 GB. I say let them keep the 8 GB claim as that sounds like more jail time to me. Win, win, win. That would be right, when fabricating cool stories cracks soon emerge. Liar liar pants on fire. I wonder if Daphne Lawless writes speeches for Liar in a Hurry too?

Its not "loonie" left stuff - just a balanced analysis as to how Attack Politics has manipulated so many from the left, right and centre into believing stuff that just ain't true.
Blocklicks she did, the info is total wrong or she was right and exposed Hagers lie. You can't have it both ways. That makes your effort to try and make her bad all good - totally & completely puzzling. Can't even say, "nice try belg"' because it wasn't.

Let me make this quite clear, this is the second Hager lie that has been exposed now. If he has been caught twice in quick concession fabricating stories, what is going on here because these are supposed to be direct copies of the stolen emails illegally hacked. Kind of rolling up to the Drags at Meremere and saying your V8 is standard when infact it's fully blown. Hager is the dirty little fool he looks like and mark my words, although KDC is pulling Hagers strings, Hager will be the fall guy.

It is a very serious criminal offence to blackmail a Minister. If true very damaging to Rodney who is now retired from politics and a happily married man.
Mr. Hager did not check these claims before going into print. Rodney was shocked to learn of it. He knows of no blackmail or texts.
Rodney contacted the people mentioned in the story – not ACT members – who totally deny the claims.
There are no texts, there was no blackmail. The Letter which claims to be reasonably well informed about ACT, has never heard the allegations before. Mr. Hager’s breathless allegations appear to be dissolving.
On the day of the launch he claimed the National Party had hacked the Labour Party’s website, a very serious charge. Within 24 hours it turns out Mr. Hager is referring to the fact that the Labour Party published on their website a list of their donors, an action the Labour Party has apologized for.
On TVNZ when asked “what is the most serious allegation in the book” Mr. Hager says it is Judith Collins revealing the name of the civil servant in charge of Bill English’s ministerial house! We do not live in a secret society. The names of civil servants is public information.
My emails are a work in progress. They contain many, many, many unsubstantiated and wild bits of gossip.
I often get emails from people who try to set me up. They look a bit exciting, but need to be culled from the herd through further research.
When I investigate these claims, I have various methods of trying to find out the veracity of these things.
So just to grab an investigative journalists work emails and then trying to make sense of them as if they are fact is wrought with problems.
With the police prosecutions and privacy complaints coming his way, I hope he realises he’s been set up by his own team to be the fall guy.

More recently, Chris Trotter posted this. It's accurate: why John Key is behaving like he is. He's terrified.


IT WAS THE GERMAN CHANCELLOR, Otto von Bismarck, who warned his countrymen that “laws are like sausages, it is better not to see them being made.” The same could be said for democratic politics generally. That democracy, like a good sausage, is a wonderful thing, but you really do not want to know what goes into it.
With this in mind, it is tempting to take Nicky Hager to task for grabbing us all by the scruff of our necks and dragging us into the sausage factory. This is especially so when we consider the observations of right-wing political fixer, Simon Lusk, who Hager quotes in the first chapter of in his book Dirty Politics: How Attack Politics is Poisoning New Zealand’s Political Environment.

In an e-mail to Hager about negative campaigning Lusk writes: “The are a few basic propositions with negative campaigning that are worth knowing about. It lowers turnout, favours right more than left as the right continue to turn out, and drives away the independents. Voting then becomes more partisan.”

If Lusk is correct then the publication of Dirty Politics could have the perverse outcome of suppressing the vote of those disgusted and demoralised by Hager’s revelations while ensuring the maximum turnout possible by voters sympathetic to John Key and the National Party.

It is certainly possible to infer from the response-lines agreed upon by Key and his allies that this is precisely the outcome they are seeking. It is presumably the reason for their constant reiteration of the idea that Hager’s revelations are nothing new, or even very remarkable, given that it has always been thus in the deeply compromised world of politics and politicians. This idea of the ubiquity of political evil is reinforced by TeamKey’s insistence that Hager’s behaviour is morally indistinguishable from that of the dark anti-hero of Dirty Politics, the blogger Cameron Slater. The sub-text here is simple: No one in politics has clean hands – even Hager. After all, his book could not have been written had the very same sort of hacking and privacy breaches which he so roundly condemns when practiced by the Right not supplied him with an information treasure-trove that was simply too compelling not to use.

Key, himself, has no choice except to point-blank refuse to engage with Hager’s allegations in any way. Were he to do so, Hager would be able to claim victory. This is because, in the most brutal terms: an allegation responded to is an allegation taken seriously; and an allegation taken seriously is an allegation which could, quite possibly, be true.

The moment Key allows the Chief Prosecutor, Nicky Hager, to have the Prime Minister called as a witness before the Court of Public Opinion, then, regardless of the nature of the evidence provided, the impression of there being a case to answer will be indelibly stamped on the voter’s mind. And that is “Game Over” for Key and the National Party.

No matter how shrill and false he may sound in the ears of Hager’s supporters, the Prime Minister will continue to refuse to acknowledge the possibility that Hager might be onto something. From now until Election Day, the author of Dirty Politics can only be “a screaming left-wing conspiracy theorist” who is “making it up”.

And there is method to this seeming madness. Key understands that his followers have been rattled by the appearance of yet another pre-election book by Nicky Hager. Their hero must, therefore, stand strong in the face of his persecutor.

The Prime Minister will make the same claims over and over again: Dirty Politics is without foundation; part of a vast left-wing conspiracy to bring him and his government crashing down; just one more vicious assault to set alongside obscenity-shouting students, anti-Semitic boguns, and a feral underclass of John Key effigy-burners. The slightest concession to even the most trivial of his persecutor’s accusations will be interpreted by his followers as weakness – tantamount to a full confession of guilt.

This is why the prime Minister is standing rock-solid behind his former staffer, Jason Ede. Why he will take no action whatsoever against his Minister of Justice, Judith Collins. Why he accepts the denials of Cameron Slater without demur. And why he will not deign to read even so much as a single word of Dirty Politics – not while he is so clearly the victim of dirty politics.

The Prime Minister can adopt this strategy because he knows that TeamKey is sufficiently powerful to block any serious attempt by the mainstream news media to take up the cudgels on behalf of Hager’s allegations. The public broadcasters will not dare to do it and the commercial networks and newspapers will not want to do it.

This failure will only intensify the feelings of disgust among those who feel there is something very rotten at the heart of New Zealand’s political system. In a grotesquely ironic abdication of the very civil responsibilities Hager’s book is intended to strengthen and mobilise, thousands of New Zealanders may yet abandon the political field altogether, calling down a plague on the houses of both the Right and the Left as they depart.

If that happens then the cynical political analyses of Otto von Bismarck and Simon Lusk will be vindicated. Hager will have demonstrated that although he is able to lead voters into the interior of the sausage factory, he cannot make them open their eyes.

Before EZ & belg rave on about quoting from C.S, Cameron Slater is part of the story making headlines right now, but even if he wasn't tough, I'd still quote him. Statement below.

As people have observed, I’m not only relaxed, I’m quite enjoying myself. People who know me will understand that I love dirty politics more than anyone else. And I fully understand people won’t believe this, but I have boundaries and ethics.

They may not be yours, but they are there.

What has been stolen contains legally, politically, medically and journalistically privileged material.

And here’s the kicker: most of it isn't about me


First things first – I’ve filed a police complaint and a complaint with the Privacy Commission.

Not so much for me, but to protect the lives of other people.

To give you an example of some of the absolutely explosive stuff that has been taken:

I was sent a database of most of New Zealand’s teachers, current and past, that have faced accusations of or have been convicted of sexually related charges with respect to their pupils.

It was compiled and maintained by a researcher using publicly available information. Most of it is under name suppression.

There are two problems with this database: First, the name suppression, second, the name suppression. I can do nothing with it. I can’t even do work and try to confirm that the information is correct, or not.

As a result, nothing came of it.

But, now a database of unconfirmed sexual charges and convictions as it relates to teachers is out there in the control of someone that may not have the same boundaries that I do.

And that, is just one example.

There is a lot in my private and journalisticly related communications that is simply unconfirmed, rumours and could be considered “work in progress”. Plainly put: not fit for public consumption.

As I have now laid complaints with the police and Privacy Commission, I will cease to make comments about this matter in public in case it jeopardises any legal action against those that broke the law.

Dirty Politics is the fruit of a criminal act. This isn’t a “leak”. This wasn’t an inside “whistle blower”. This has been, and continues to be, one of the largest organised attempts to obtain computer information and other intel by a group of people that made a clear decision to break the law for political gain.

I have higher ethics than Nicky Hager and his puppet masters and won’t be releasing any correspondence with journos or politicians, or anyone else.

If they surface, it will be, once again, a criminal act.

Let us all not forget that Dot rose to fame in Germany in the 1990s as a hacker and internet entrepreneur. He was convicted of several crimes, and received a prison sentence in 1994 for computer fraud and data espionage, and another prison sentence in 2003 for insider trading and embezzlement.

As a teenager, Dot acquired a reputation in his native Germany after having claimed to have bypassed the security of NASA, the Pentagon and Citibank under the name of Kimble – based on the character of Dr Richard Kimble in the long-running television programme The Fugitive. He also claimed to have hacked corporate PBX systems in the United States and said he was selling the access codes at $200 each, bragging that "every PBX is an open door to me."

In 1994, he was arrested by German police for trafficking in stolen phone calling card numbers. He was held in custody for a month, released and arrested again on additional hacking charges shortly afterwards. He was eventually convicted of 11 counts of computer fraud, 10 counts of data espionage, and an assortment of other charges. He received a two-year suspended sentence – because he was underage at the time the crimes were committed. The judge in the case said the court viewed his actions as "youthful foolishness."

In 2001, Dot bought €375,000 worth of shares of the nearly bankrupt company Letsbuyit.com (de) and subsequently announced his intention to invest €50 million in the company. The announcement caused the share value of Letsbuyit.com to jump and Dot cashed out, making a profit of €1.5 million. One commentator suggested that Dot may have been ignorant of the legal ramifications of what he had done, since insider trading was not made a crime in Germany until 1995, and until 2002 prosecutors also had to prove the accused had criminal intent.

Dot moved to Thailand to avoid investigation where he was subsequently arrested on behalf of German authorities. In response, he allegedly pretended to kill himself online, posting a message on his website that from now on he wished to be known as "His Royal Highness King Kimble the First, Ruler of the Kimpire". He was deported back to Germany where he pleaded guilty to embezzlement in November 2003 and, after five months in jail awaiting trial, again received a suspended sentence (of 20 months).After avoiding a prison sentence for a second time, he left Germany and moved to Hong Kong in late 2003.

Dot found Hong Kong to his liking and registered Kimpire Limited in December 2003, soon after moving there. He set up a network of interlinked companies, including Trendax which was claimed to be an artificial intelligence-driven hedge fund delivering an annual return of at least 25%. However, Trendax was never registered with Hong Kong’s Securities and Futures Commission and the company was legally not allowed to accept investments or to conduct trades. Dotcom was subsequently convicted for failing to disclose his shareholding to the Securities and Futures Commission, and was fined 8000 Hong Kong dollars.

Dot moved to NZ where most of us pick up the story including him being arrested here and spending time in Mt Eden prison. Most can see Dot for what he is, others are blind to the fact or criminals themselves.

There's plenty of stuff on the horizon - meat exports, filmmaking, tourism, population growth, and our pending oil boom & so on. Something will replace the ChCh rebuild and if more than one or two things I mentioned above come into play, then we will be fine. That's of course if the Greens/ Labour/Mana/Internet/ don't get any influence in the next Govt. Then you will have the rich getting a lot poorer, which means no investment in meat exports, filmmaking, tourism and our pending oil boom, plus no new money coming into the country with population growth which stops the building boom and new business that would be a by-product. Just the rich pricks paying more tax. How is that good? We need to keep the rich rich.


After all, if there were no well off people for the Greens to tax the bejesus out of who will they tax more? The middle & poor for sure - there goes their grand plan out the back door.

We need to keep our rich, rich and stop keeping our poor, poor. That means invite and welcome investment to help our economy grow and stop paying those who don't work to help force them to kickstart their lives for themselves. Force them to help themselves. Not tax the hell out of somebody that works hard and give that money to somebody that wont work. This is the land of opportunity & those who seek reward and get it deserve to keep it.


In caveman terminology the Greens want the best hunters to give 40% of their kill to the useless fat bastards that stay in the cave all day long and don't lift a finger except to eat the best hunters meat.

Once again, a certain person’s greasy fingers are all over it, and once again, a compliant media refuse to do their job, which is to protect us from the machinations of evil men, and make no mistake, Kim Dot Com is a liar, a thief, a con man of the highest order, and has little or no remorse. He is an evil odious little man in a big man’s body.

I simply cannot for the life of me understand how any politician who truly has the interests of this country at heart could allow himself or herself to be associated in any way with this man. If you need to ally yourself with Dot Com to attain the treasury benches, then frankly, you do not deserve them, you do not deserve to be in parliament, and you certainly do not deserve to represent me.

And I do not want you to!

So, Claire Curran, I hope that you will no longer be in parliament.

LAQCs could be replaced by LTCs (Look Through Companies) which I've done and I can't say that I've noticed much difference. Could you explain why you think the situations changed that much?

Well I'm no Tax expert but my accountant is.. when we were allowed to have LAQC I could take my companies TAX losses(If I had any from Share Trading that year) and offset my personal income from my seasonal job .....I only got to do it once as my previous years I had made Tax paid profits ..then at present under National not allowing LAQC my share trading company has TAX losses on the books but its much harder to off-set outside the company structure say you have 250k in TAX losses but your personal income is 80k if you now want to off-set you lose the other 170k in losses (well thats how my accountant put it) so your far better of keeping within the company and just off-set future profits ....I'm currently working on a Capital restructure to use up my Tax losses sooner than later....

Fungus Pudding assures us that such people would have been subject to existing tax rules (in the absence of a CGT). Are you saying that they weren't taxed as Fungus says they would have been? I.e. the tax law is so awful they just stepped around it?

-Yes here in Queenstown Speculators (many foreign) would buy land,,, then on sale only years later sometimes millions in profits and just disappear(close the company/trust etc move country) ..the whole Tax on property was a grey area you might have brought the million dollar property in a LAQC rental structure then sold years later your intention was always as rental property so no Cap Gain tax on the $$$,$$$ gain ...I know of local real estate agent's that did this muti times over the years making a killing....just keep closing down the companies starting new one up...

It takes more than two polls to confirm a trend, but there are signs of some very significant straws in the electoral wind.

The latest Herald-DigiPoll survey and Wednesday's 3News-Reid Research poll suggest support for some minor parties is starting to fracture. This is the upshot of the decline in the Labour-Greens bloc. It has now shed more than 10 percentage points in the past nine months.

Labour has been the major casualty. But the Greens do not seem to be benefiting, their support remains around the 2011 election level. In contrast, New Zealand First, the Conservatives and Internet-Mana seem to be on the rise.

The Greens may be paying for not being able to work with National. It looks like those who would lean Labour's way are starting to drift to New Zealand First instead of the Greens. Winston Peters has cleverly marketed his party's potential role as a brake on a third-term National Government by suggesting it might sit on Parliament's cross-benches and stay out of power, using its votes in the House to keep John Key "honest" - as Peters puts it.

The really intriguing battles centre on the pitch for young and elderly voters. The breakdown by age in the Heraldpoll has to be treated with caution because of the low sample numbers in each category.

The Greens, however, are holding steady among 18- to 39-year-olds. The gains are being made by Internet-Mana, which has positioned itself as the anti-Establishment party, thus filling the gap left vacant by the Greens in its search for more middle-of-the-road respectability, especially on economic policy.


Like Internet-Mana, Colin Craig's Conservatives also now look like bettering the 5 per cent threshold, especially because wavering voters will now have more confidence their votes will not end up being wasted.

Craig seems to be pulling votes off Labour, whose share of the votes of the elderly has basically halved since Helen Clark's heyday. There is also a hint that Craig is starting to squeeze New Zealand First's grip on the elderly.

That suits National fine - as long as Craig does not start poaching National's support. Backing for the governing party fell slightly in the 3News poll, but remained static in the Herald poll.

And that is one of the two big questions. Will National's support start to go into decline? It is too early to say. The other question is whether Labour can go any lower. Hard to say. But no one would bet against it.

It is pretty clear that come what may in the election, Hagar and other face the prospect of being hoist with their own petard before all this is over and, hopefully, never again will the people of this land allow such an accumulation of rubbish to gather at the foot of the political ladder. Permanent residency status should be subject to immediate review by the minister should the holder decide to attack the state and its ministers who are lawfully elected by the people and any incursion into the private affairs of individuals or state departments by individuals crossing the common lines of privacy should be subject to criminal prosecution. That prosecution should also apply to those who - or so they claim on here - hack into fellow posters.

There is no way around it Hager needed to show double standards in order to release his fictional book which should be call "Cool Stories".

Was at a function recently where Brownlee was asked if legislation would be passed to clarify it is a punishable offense. He said Yes. So Nicky is living on borrowed time :-)

Laws are not applied retrospectively, so even if it is changed, unless he has commited an offence based on the law as it is today, he won't be prosecuted.

I didn't realise that Gerry was Minister of Justice. Yes, passing of laws applying retrospectively... Hmm interesting policy platform for the election, I and no doubt many others await with eager anticipation of further details. I guess another reason to stay well clear of " duplicitous John" at this election

Details of what purports to be the contents of a leaked email from blogger Cameron Slater to Mark Hotchin and PR man Carrick Graham, dated October 5, 2011, particularly disturb me.
According to these reports Slater wrote that Justice Minister Judith Collins was "gunning for" Serious Fraud Office boss Adam Feeley. The email, and subsequent revelations, seemed to me to indicate that parties aligned with Hotchin decided, or were advised, that the best way to defend his role in the Hanover Finance debacle was to attack his critics. These appear to include Financial Markets Authority boss Sean Hughes and Feeley.
If it is true, then the leaked October 2011 email also has relevance to this column because a few months earlier Hotchin lodged a defamation claim against the New Zealand Herald and myself for a number of my Weekend Herald opinion columns between November 2008 and March 2011.

The opinions I set out in the columns were at times critical of Hotchin and his role in the effective collapse of Hanover Finance.
The defamation claim had an impact on my willingness and ability to continue writing about Hotchin and Hanover and this is my first column on the subject since March 2011.
Hopefully, alleged attacks on the FMA and SFO haven't had a similar impact on their willingness and ability to fully investigate the activities of Hanover Finance.
The Hanover Finance story effectively began in December 1999 when Hotchin and Eric Watson gained control of Elders Finance. The company grew rapidly and changed its name to Hanover Finance in September 2005.
Hanover relied heavily on Richard Long, the former television newsreader, to attract investors through an extensive TV and print advertising campaign.
The Long strategy was highly successful and by June 2006 the finance company had total assets of more than $1 billion.
However there there were a number of controversial issues regarding Hanover including:
• The company had a very high level of related party loans (loans to parties related to the main shareholders). These loans totalled $197.5 million, or 19.4 per cent of total assets, as at June 30, 2006.
• Hanover Finance's loans were mainly property development oriented with over 90 per cent of the interest income capitalised.
On July 23, 2008, Hanover Finance suspended repayment of capital and interest on its debentures and bonds. This announcement was made just a month after the company paid a dividend of $5.5 million.
On December 9, 2008, Hanover Finance investors approved a moratorium whereby debenture holders were supposed to receive 100 per cent of their money back by December 2013.
On November 10, 2009, Hanover announced that investors would receive only 70 per cent, instead of 100 per cent, of their capital back. A week later the company announced that it had entered an agreement to sell the entire business to Allied Farmers, the struggling NZX company.
The consideration for each 100 cents' worth of Hanover Finance debentures was as follows:
• Investors would keep the 6c repaid to them under the moratorium approved in December 2008.
• 22c of every 100c would be written off.
• Investors would receive 3.4794 Allied Farmer shares for the remaining 72c outstanding.
Since then Allied Farmers has had a one for 100 share consolidation and the 3.4794 shares have become 0.034794 Allied Farmers shares. As Allied Farmers' shares are now trading at 8.6c these 0.034794 shares are worth just 0.3c. Thus, Hanover Finance debenture investors have received 6 cents in cash and, with their Allied Farmers shares worth 0.3 cents, their total return is only 6.3c for every 100c invested.
Investors in Bridgecorp, another finance company disaster, have received 8c for every 100c invested with the possibility of more to come.
Hotchin's defamation claim was lodged after my opinion column written in response to a radio and television blitz by Hotchin presenting his side of the Hanover debacle.
In the column I quoted the following exchange between Hotchin and TVNZClose Up presenter Mark Sainsbury on the Allied Farmers transaction:
Sainsbury: "But you were out there at those meetings telling the Hanover investors take this deal ... this is gonna be good for you. It hasn't been good for them."
Hotchin: "No clearly, and that's why I'm here. The whole point is we were sold a concept and an idea and they [Allied Farmers] haven't delivered, and they haven't even come close, it's so far away."
Sainsbury: "So are you saying you were hoodwinked?"
Hotchin: "Totally."
The Sainsbury interview went on to discuss Hanover's dividend payments and related party transactions as follows:
Sainsbury: "How could you take dividends out?"
Hotchin: "Because they went back in, it was liquidity, every dollar that went out two dollars was going back in, so it was actually creating liquidity."
In my opinion Hotchin's 2011 media interviews were bizarre because the Hanover story seemed to have run its course. Hotchin supported both the 2008 moratorium and the Allied Farmers transaction the following year.
The reporting of the leaked emails last weekend seems to suggest to me that those aligned with Hotchin were concerned about FMA and SFO investigations and appear to have decided to attack the regulators.
Media reports of the leaked emails also suggest Carrick Graham, his PR consultant at the time, may have been involved.
These media reports also suggest parties aligned with Hotchin may have been secretly paying bloggers Cameron Slater and Cathy Odgers to write negative posts about the FMA and SFO.
I believe the FMA and SFO would have been well aware of these blog attacks because big organisations circulate daily media briefings, in paper or electronic form.
These briefings usually contain copies of all references to the organisation in the conventional print media, blogs or web comments.
They also contain transcripts of important radio and television references.
Former FMA chief executive Sean Hughes told Kathryn Ryan on Radio New Zealand this week that he was aware of what appeared to be attacks through his organisation's daily media briefing. He said they were "an attempt to distract" the organisation but he rejected any suggestion that former Justice Minister Judith Collins, or any other minister, tried to influence the FMA and any of its investigations.
He said he had been a regulator in a number of countries but "had never experienced the level of personal denigration" that he had been subject to in New Zealand.
He went on to say that listeners may be surprised to hear this, particularly as he had worked in Australia.
Hughes also said that what appeared to be personal attacks had "certainly influenced" his decision not to seek a second term at the FMA.
He said that they had been "a disincentive".
This column is disturbed by media reports that the leaked emails seem to show parties aligned with Hotchin paid bloggers to attack the FMA and SFO.
The integrity of our capital markets is very dependent on public issuers putting the interests of investors first and having regulators willing and able to take action when there are allegation that this important principle may have been breached.
In my experience being subject to defamation claims can leave you feeling intimidated and unable to write about a controversial subject.
Hopefully our regulators haven't felt the same level of intimation and restriction when they have been attacked though blogs, social media or other communication forum
